Restricting the U.S. Visa Waiver Program Is a Bad Idea for Business
In the aftermath of last week’s brutal attacks in Paris, conservative U.S. politicians are calling for a crack down on travel from 30 countries with muslim residents.
Sen. Rand Paul introduced legislation on Monday that would “impose a 30-day waiting period for all entries to the U.S. in order for background checks to be completed, unless the traveler has been approved through the Global Entry program.”
It would also “suspend issuance of visas to nationals of countries with a high risk of terrorism” until more stringent screening and surveillance methods are put into place by the U.S. Department of Homeland Security.

Visa Bulletin: More Changes Impacting the I-485 Process
As previously reported in our legal update from September 10, 2015, the Department of State (DOS) made a major change to the Visa Bulletin in early September. Then, on September 25, 2015, that Visa Bulletin was rescinded and replaced with a new bulletin. Since that time, a lawsuit was filed in the Western District of Washington, DOS published the November Visa Bulletin, the United States Citizenship and Immigration Services (USCIS) issued guidance on when to file, and rumors abound. Here is what you need to know about the changes to the Visa Bulletin.

The privilege of natural-born U.S. citizenship
After nearly seven grueling years, I reached my first lifelong goal on Aug. 9. I became a U.S. citizen.
During
the first two years of processing my permanent residency for the United
States, I battled various culture shocks studying in South Korea and
later in Canada—my parents had been denied visas to return to the United
States. Depression and anorexia set in when I realized I had to abandon
my childhood home and friends in America.
After coming
back to the United States in 2010, I saw my family break up to the point
that my father was unable to live with me until 2012 because he could
not find a stable job in the United States. To me, my U.S. citizenship
represents all the tears I shed during family feuds, the mockery hurled
my way for my low-income status, and the suicidal thoughts that I’ve had

Deadline approaches to submit online entry for Diversity Visa Lottery
You have until noon on Tuesday, Nov. 3, to submit your online entry for the Diversity Visa Lottery — which gives green cards to 50,000 randomly selected people from countries with relatively low immigration to the U.S.
Natives of most countries qualify — except those from Bangladesh, Brazil, Canada, China, Colombia, the Dominican Republic, Ecuador, El Salvador, Haiti, India, Jamaica, Mexico, Nigeria, Pakistan, Peru, the Philippines, South Korea, Vietnam, and the United Kingdom and its dependent territories aside from Northern Ireland.
Those born in Northern Ireland as well as Hong Kong, Macau and Taiwan are eligible. Winners get their visas during the 2017 fiscal year. Immigration report finds systemic detention failures
Inspections at immigrant detention centers across the country lack legitimacy and are carried out with little oversight or transparency, a new report by two pro-immigrant advocacy groups charges.
The report, released Wednesday by the organizations National Immigration Justice Center and Detention Watch Network, is based on documents obtained through years of litigation and Freedom of Information Act requests examining 105 immigrant detention facilities nationwide. US visa applicants warned of online scams
Applicants to a US Green Card scheme, which opened earlier this month, have been warned against online fraudsters.
The Diversity Visa Lottery opened on October 1st. It will issue 50,000 visas, with a maximum of 3,500 going to Ireland.

two-years work experience in the last five years in an occupation that

Automatic right of American-born children to U.S. citizenship — which Donald Trump wants to end — ratified in 1868
The automatic right of people born on American soil to citizenship
rests on the 14th amendment to the U.S. Constitution, ratified in 1868.
The amendment nullifed the 1857 Dred Scott ruling by the Supreme Court that denied citizenship to African-Americans.
It reads: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the state wherein they reside."
In an 1898 case, the court interpreted the amendment to give citizenship to the San Francisco-born son of Chinese nationals. The ruling established judicial precedent ensuring anyone born in the U.S., except for children of foreign diplomats, is a citizen. Left Out of Visa Waiver Program, Polish Visitors Ask: 'Why Not Us?
Since 1986, the United States has been granting visa waivers to citizens of countries it sees as trusted allies. Someone from France or Spain can, relatively easily, use a passport and visit for up to 90 days. There are 38 countries whose citizens do not require visas to enter the United States.

Born in the U.S.A.—Citizenship and the Constitution
In your editorial “Born in the U.S.A.” (Aug. 21) you assert that the language of the Fourteenth Amendment is “straightforward.” It is indeed, but it doesn’t mean what you claim. The amendment sets out two requirements for automatic citizenship, not just one. A person must be born in the U.S. and subject to its jurisdiction, according to the text. Those who drafted the language were quite explicit; the latter phrase meant subject to the “complete” jurisdiction, “[n]ot owing allegiance to anybody else.” As Sen. Jacob Howard explained at the time, the Citizenship Clause excludes not only Indians but “persons born in the U.S. who are foreigners, aliens, [or] who belong to the families of ambassadors or foreign ministers.” In other words, the phrase didn’t mean what they called “partial” or “territorial” jurisdiction such as applies to “sojourners” who are mere temporary visitors, and it certainly didn’t apply to those who were unlawfully present in the county. Critics say US visa program for wealthy foreigners is 'immigration reform for the 1 percent'
With immigration a hot topic on the U.S. presidential campaign trail, unions and immigrant advocates are focusing attention this week on a federal visa program that they deride as “immigration reform for the 1 percent.”

Moscow outraged as US restricts Russian upper house chair’s visa for intl conference in NYC

Department Of State Releases September 2015 Visa Bulletin
The US Department of State (DOS) has released its September 2015 Visa Bulletin. The Visa Bulletin sets out per-country priority date cutoffs that regulate the flow of adjustment of status (AOS) and consular immigrant visa applications. Foreign nationals may file applications to adjust their statuses to that of permanent residents or to obtain approval of immigrant visas at a US embassy or consulate abroad, provided that their priority dates are prior to the respective cutoff dates specified by the DOS.

U.S. EB5 Investor Immigration Program: Does It Have A Future?
Earlier this year, Brian Ross of ABC News wrote a series of stories attacking the U.S. EB5 investor immigrant program alleging it was rife with fraud and corruption. As an indication of how wide-spread the problems were, ABC News later revealed that a federal Government Accountability Office report found,

Tougher Standards Set for U.S. Visa Waivers, Citing Militant Threat

GOOD NEWS: Nigeria To Be Included In US Visa Lottery Eligibility List?
Nigeria along with the UK and other countries may be returned to the eligibility list of the US Visa Lottery program.
Nigeria was removed the from list in 2015. However, the document is modified every year based on trends of the previous five years, The Nation reports.
Commenting on the possible development, Ashley Garrigus, spokesperson for the US Citizenship and Immigration Services, explained:
“The Congressional-mandated Diversity Immigrant Visa Program (DV) makes available up to 55,000 diversity visas each year, drawn from random selection among all entries to persons who meet strict eligibility requirements from countries with low rates of immigration to the United States. The section of the law establishing the Diversity Visa program limits the list of “eligible countries” to those countries from which fewer than 50,000 persons in various visa categories immigrated to the United States during the previous five years." In her book “¡Adios America!: The Left’s Plan To Turn Our Country Into A Third World Hellhole,” author Ann Coulter makes the case that that the 14th amendment doesn’t or at least shouldn’t give rights to immigrants because it was passed in the cntext of black slavery. Constitutional scholar and author Robert J. McWhirter disagrees and criticizes conservatives who advocate interpretations of the Constitution as "originally intened." He takes on Republican presidential candidates like Donald Trump and Ted Cruz for hopping on the tough-on-immigrants bandwagon. In this op-ed (we’re not endorsing the content), McWhirter argues that immigrants’ rights are enshrined not only in the nation's core laws but in the original visions of America’s founding fathers.
“We the People … ,” are the first words of our Constitution, not “We the citizens.” “ We the People … ” means everyone has rights – that is the big idea of a big place called America. The Declaration of Independence, the first definition of America, started the idea that, all men are created equal and that they are endowed by their creator with certain inalienable rights. . .
Again, it’s not “all citizens are created equal.” Rights are as inalienable to aliens as anyone else.

Glitch In U.S. Visa System Leaves Hundreds Of People Stranded
A “technical glitch” that has affected the State Department’s ability to issue visas at consulate across the globe has prevented some U.S. citizens from returning home, in some cases putting them at risk of financial ruin or exacerbating medical issues.
The State Department on Friday announced that it was having “technical problems” with its visa processing and issuing systms. And John Kirby, a spokesman for the department, told reporters that the problems are expected to continue for at least another week.

Immigration Reform 2015: California Wants To Bypass Feds, Give Work Permits To Undocumented Immigrants
California lawmakers have proposed a program that would grant work permits to undocumented immigrant farmworkers and their families, the Los Angeles Times reported. The legislation passed through the Assembly in June and is currently pending in the Senate.
The bill, introduced by Assemblyman Luis Alejo and backed by California farmworkers, would create a group that would seek authority for the permits from the U.S. Department of Homeland Security and the U.S. Department of Justice. The program would give permits to farmworkers already living in the state without authorization.
The workers, their spouses and children under 18 or enrolled at an accredited institution would be spared from deportation. The workers would need to be at least 18 to qualify. They would be required to pay a fee toward administrative costs. Felons would not qualify.

US visa meltdown: when will the system be working again?
What's going on?
The hardware failure, which began last week at the US Department of
State's Bureau of Consular Affairs, is preventing officials from
processing the mandatory security-related biometric data checks that
accompany visa applications fromaround the world. The government said

Immigration Reform 2015: Obama Executive Action Lawsuit Heads Back To Court
The U.S. Fifth Circuit Court of Appeals will hear opposing oral arguments from representatives of the federal government and of 26 states in New Orleans Friday on the implementation of President Barack Obama’s execution action to shield millions of undocumented immigrants from deportation. The two sides have been locked in a legal battle since December 2014, when the Texas-led state coalition challenged Obama’s orders as unconstitutional.
The two sides will argue for and against Obama’s “Deferred Action for Parents of Americans” and “Deferred Action for Childhood Arrivals” programs – key aspects of his order last November to shield as many as five million undocumented immigrants who met certain criteria from deportation, the Los Angeles Times reported. A panel of three judges, two of whom are regarded as conservatives, will preside over the hearing, in a case that many suspect the U.S. Supreme Court will eventually decide.
The states’ representatives have argued Obama’s attempt to enact nationwide immigration reform without legislative approval violated states’ rights under the Constitution. The Justice Department asserted the states have no legal basis on which to contest Obama’s actions. Representatives from each side will have one hour and 20 minutes to make their arguments, not including interruptions from the panel of judges.

Immigration Reform News Today: John Boehner Says Reform is Top Priority, But GOP Remains Weary
House Speaker John Boehner, R-Ohio, plans to make immigration reform a top priority, the top Republican told business executives in Dublin, Ireland, over the weekend.
The U.S. News & World Report noted his remarks were surprising given congressional Republicans' resistance to the issue, as well as his own refusal to put the matter up for a vote in the House of Representatives.
While speaking at an Independence Day luncheon at
the American Chamber of Commerce Ireland, Boehner recounted how
Taoiseach Enda Kenny -- the Irish equivalent of a prime minister --
urged him to tackle the overhaul of the U.S. immigration system, the
Irish Times detailed. Kenny told Boehner that "the lack of reform has left some Irish immigrants listening to a parent's funeral by phone."
"Oh John, John, you don't realize there are about
(50,000) of my fellow Irishmen came to the U.S. and never quite made it
back across the pond," the premier is said to have told Boehner.

Immigration Reform 2015: Undocumented Immigrants Should Get Citizenship, Say 83% Of Iowa Democrats In New Poll
Likely voters in the early presidential battleground state of Iowa are sharply divided along party lines when it comes to U.S. immigration reform. Just 34 percent of Republicans said the U.S. should give immigrants in the U.S. illegally a path to citizenship, while 83 percent of Democrats said undocumented immigrants should be allowed to apply for permanent residency, a Quinnipiac University poll released Monday indicated.
Peter A. Brown, the poll’s assistant director, described the partisan divide as “striking” in a statement. “Ideas that are part of Democratic orthodoxy are an anathema to Republicans, and vice versa,” Brown said. “Democrats think illegal immigrants should be able to stay in the United States and eventually become citizens. Republicans don’t.” The poll also found 46 percent of Republicans said undocumented immigrants should be forced to leave the U.S., compared to 8 percent of Democrats.
Brown added voters in Iowa, which will play host to the country’s first presidential caucuses in February, often regarded as an indicator of how voters might lean in national elections, are “a perfect example of just how differently Democrats and Republicans see completely different worlds.”

Immigration News Today: Unaccompanied Immigrant Minor Detention Falls By Half Compared to 2014
The rate of unaccompanied undocumented immigrant minors entering the U.S. has fallen by more than 50 percent.
The U.S. Customs and Border Protection (CBP), an agency within the U.S. Department of Homeland Security, disclosed the apprehension rate of unaccompanied undocumented immigrant children at the southern border dropped by 51 percent during the 2015 fiscal year, so far, compared to the same time frame of the 2014 fiscal year.
Between Oct. 1, 2014, and June 1, 2015, CBP agents apprehended 22,869 unaccompanied minors, categorized as children ages 17 and younger. In comparison to the same time period during the 2014 fiscal year, CBP apprehended 46,858 unaccompanied minors.

Immigration Reform 2015: DHS Decreases Deportations, Integrates Undocumented Immigrants
Under the direction of the Obama administration, the Department of Homeland Security has started changing the enforcement of United States immigration laws, focusing on integrating long-term undocumented immigrants instead of deporting them. The DHS has shifted its methods of enforcement to target only three groups of undocumented immigrants for deportation: convicted criminals, terrorism threats or those who recently crossed the border, according to the Washington Post.
The new policies push agents to ignore the majority of undocumented immigrants except for the three focus groups, and come amid legal challenges to the President Barack Obama's executive action from last year, Deferred Action for Parents of Americans, which protected roughly 5 million eligible undocumented immigrants from deportation who have children who are U.S. citizens or legal residents before a federal judge put a stay on its enforcement until the conclusion of the lawsuits.

U.S. Visa System Back Online
WASHINGTON—All overseas embassies and consulates are able to issue visas again after a system failure earlier this month disrupted their ability to do so across the globe.
“It is too soon to get an exact estimate” of the financial losses caused nationally by the delay in the arrival of thousands of farm laborers, said Jason Resnick, general counsel for Western Growers, a large association. “In California, we know that crop losses were at over a million dollars a day for over two weeks of the delay.”
The losses were primarily in strawberries and other berries. Employers also had to pay for lodging and food for workers stranded at the border, he said.

Obama Immigration Reform 2015: Illegal Immigrants In US Won’t Get Free Healthcare Under Obamacare, Says President
U.S. President Barack Obama touched on immigration reform on Wednesday while discussing the progress of the Affordable Care Act, also known as Obamacare, in Nashville, according to WDTN. When asked about a course to citizenship for undocumented immigrants, the president reiterated that the healthcare law does not make coverage available to people who are in the U.S. illegally, Obama said during a private event at Taylor Stratton Elementary School – his third visit in 18 months to a Nashville public school.
It was a point Obama has made before when faced with questions of whether the president’s healthcare law would mean millions of undocumented immigrants would suddenly get free healthcare through Obamacare. Under the law, undocumented immigrants are not eligible for federal coverage, including Medicare and nonemergency Medicaid, however they could access emergency care under federal law. They also cannot purchase private health insurance through state insurance exchanges, according to the National Immigration Law Center.

Immigration Reform News Today: ICE Announces New Guidelines For Detained Transgender Immigrants
The U.S. Immigration and Customs Enforcement (ICE) agency announced new guidelines when detaining transgender immigrants.
A new guidance for ICE and the Office of Enforcement and Removal Operations (ERO) called for three new elements in regards to the treatment of transgender immigrants in custody.
The first element is to appropriate data systems and update it to record an individual's gender identity. The second new guidance calls for "comprehensive" officer training and tools "to ensure an individual's gender identity can be identified early" while in detention.
Finally, ICE addressed its housing practices for transgender immigrants. According to ICE, the memorandum includes "a voluntary ICE detention facility Contract Modification," which calls for the creation of a facility-based multidisciplinary Transgender Care Classification Committee. The committee will be tasked to make decisions related to searches, clothing options, medical care and housing assignments and reassessments.

Immigration reform news 2015: What's Bernie Sanders' take on the immigration issue?
Democratic presidential candidate, Bernie Sanders, appeared in a meeting with Latino officials last week and his speech was mostly targeted toward support for immigration reform.

Immigration Reform: Signature Collection Underway For California Initiative To Give Undocumented Immigrants Residency
An initiative to give residency permits to immigrants living in California illegally is gaining momentum in the country’s most populated state, where backers of the measure are gearing up to begin collecting signatures to get the proposal before voters in 2016, according to Los Angeles Daily News. The California Immigration Reform Act would require permit holders to pay state income taxes and bar the state from using public funds to aid federal immigration enforcement.
Backers, who gained permission to begin collecting signatures Wednesday, have until Dec. 21 to get the required 365,880 signatures from registered California voters to put the initiative on the 2016 ballot. Immigrants who take part in the program would not have to show proof of immunizations until they apply for permanent residence cards, which would be made available only after five years of living in the state. The permits would establish an official arrival date in the country and give immigrants a tax identification number to allow them to attend school or apply for jobs.

Delays in U.S. Visa Processing Due to U.S. Department of State Technical Problems
On June 15, 2015, the U.S. Department of State (DOS) announced that its visa system is experiencing technical problems, which are now causing significant delays in visa processing. The technical problems are preventing the DOS from performing national security checks, without which the DOS may not issue visas to foreign nationals. The DOS is also unable to print some visas upon approval. The issue is not specific to any particular country or visa category.
The DOS has made some progress in restoring its
visa processing capabilities, and the Department is working around the
clock to restore the system to full functionality. In the meantime, the
visa backlog continues to grow. Many applicants are currently waiting
several weeks for visa appointments at U.S. consulates abroad, and
applicants at certain consulates must continue to wait for their
approved visas to be printed and issued. On June 23, 2015, the DOS
issued a list of consulates that are connected and able to issue visas.

U.S. Visa Glitch Continues to Stall Workers, Strain Farms
A computer hardware problem continues to cripple U.S. visa processing around the globe, stranding tens of thousands of foreigners who need to reach the country for business, weddings and funerals and other purposes.
A few hundred agricultural workers who were stalled near the Mexico-U.S. border have entered since the problem began. But many more remain there, farmers said, unsure if they will get visas before crops rot.
“We are talking about a situation now where we are falling further and further behind,” said Daren Gee, a major California strawberry grower. He said 200 seasonal workers he has arranged to employ had been delayed 19 days as of Friday, costing him $25,000 to $30,000 a day mainly in potential revenues.

Congress needs to pass immigration reform before 2016
Most of us grow up hearing about how we should practice loving our neighbors. Well, Mexico is our neighbor; maybe we should start acting a bit more neighborly! The same can equally be said of Mexico. Why do both sides spend so much political rhetoric demonizing each other?
I live in Texas, and, like most Texans, am darn proud of it. As it stands right now, I am a minority in my state. My answer to that is: so what? I was born in Texas as a minority: a Swede! But my mother and father were Americans first and never taught me Swedish — something I sometimes now regret, although I understand how important it was for me to be accepted into "our" country.

American Samoans don’t have right to U.S. citizenship, court rules
WASHINGTON (AP) — A federal appeals court ruled Friday that people from the South Pacific islands of American Samoa do not have a right to U.S. citizenship simply because they were born in the U.S. territory.
The ruling from the U.S. Court of Appeals for the District of Columbia Circuit preserves federal laws that make those born in American Samoa U.S. nationals, but not citizens like people born in Puerto Rico and other territories.
Writing for a three-judge panel, Judge Janice Rogers Brown said the Constitution’s 14th Amendment does not automatically extend birthright citizenship to the nation’s unincorporated political territories.

EDITORIAL: Move on immigration reform
On Thursday, Pew Research Center released poll results indicating widespread support for substantive immigration reform.
The nationwide survey indicated that 72 percent of Americans support allowing people living illegally in the United States to stay, under certain conditions; 42 percent directly supported a pathway to citizenship; and 26 percent supported at least allowing illegal immigrants to apply for permanent residency.
These finding roughly echo a survey conducted by the Public Policy Institute of California in March, finding statewide support for immigration reform. U.S. Firms, Workers Try to Beat H-1B Visa Lottery System
Companies eager to hire foreign talent, mostly in the tech sector, and workers hoping for jobs in the U.S. have found ways to game a government lottery used to distribute a limited number of visas each year.
Immigration lawyers involved in the process say they have helped companies file multiple H-1B skilled-worker visa applications for the same person. Some workers, meanwhile, are accepting offers from multiple employers, each of whom files a petition on their behalf, the lawyers say.

Passing U.S. citizenship requirements a difficult challenge for older refugees
Khin Shwe, a refugee from Burma, now called Myanmar, was 68 when she was resettled by the U.S. State Department to the United States in 2008. She first lived in Ohio but later moved to Fort Wayne to join her daughter, who is married with three children. She has been trying to learn English since she arrived.
“It is very hard,” Shwe said through an interpreter, Nyein Chan, who is refugee resettlement coordinator for the Fort Wayne office of Catholic Charities of the Diocese of Fort Wayne-South Bend. She is working now on learning the alphabet.

DOS June 2015 Visa Bulletin - Department of State
The Department of State’s June Visa Bulletin on a whole brought relatively few changes of note.
Progress was made in the EB-2 category, where
priority dates for Indian nationals advanced six months from April to
October 1, 2008. Similarly, Chinese nationals experienced forward
movement of one year in priority dates, with the Department of State
(DOS) now processing cases with priority dates of June 1, 2013 or
before.

Homeland Security Official Defends Handling of Visa Program
The deputy secretary of Homeland Security, Alejandro Mayorkas, conceded at a congressional hearing on Thursday that his intervention in three cases of visas for foreign investors had created an impression of political favoritism, and he said he regretted fostering that perception. When traveling abroad would-be U.S. citizens must be aware of the physical presence and continuous residence requirements
Travel abroad can impact two requirements to naturalize, the physical presence requirement and the continuous residence requirement. To meet the physical presence requirement you must have spent at least half your time in the U.S. in the qualifying years before you apply to naturalize. For most applicants, the qualifying years of permanent residence needed is five years. Three years if you are applying under the special rules for the spouse of U.S. citizen. Only religious workers and members of the military are exempt from the physical presence requirement. These cities have the most high-skilled foreigners
Silicon Valley and NYC aren't the only places with a lot of foreign tech workers.
According to a report released Thursday by Brookings Institute,
metro areas like Dallas, Detroit and Durham-Chapel Hill have a big
share of workers on H-1B visas, the most common visa for highly skilled
foreigners. On Wednesday, the application period for H-1B visas opened up, but there's an annual quota of 85,000.
If the demand during the first week exceeds the cap -- last year there were 172,500 applications -- the U.S. Citizenship and Immigration Services dolls out the visas at random via a lottery system.

Feds deny more visas for 'specialized' foreign workers
Foreign employees of U.S. companies are having a harder time getting into the country under a specialized visa category, according to a report being released Wednesday.
About 35% of petitions by American companies to bring to the U.S. employees working overseas who have a "specialized knowledge" in their fields were denied in 2014 by U.S. Citizenship and Immigration Services, the fourth straight year that figure has risen. The denial rate for those visas, known as L-1B visas, was as low as 6% in 2006, according to the report from the National Foundation for American Policy, an immigration advocacy group. U.S. immigration authorities are detaining people considered of low priority or who qualify for the immigration relief announced by President Barack Obama, according to the American Immigration Lawyers Association, known as AILA.

U.S. District Judge Andrew Hanen of Texas has temporarily blocked President
Obama's executive action on illegal immigration by granting a request
from 26 states to allow the courts to look at its constitutionality
before it is implemented. The lawsuit is being headed by Texas Governor
Greg Abbott.
"This case examines complex issues relating to immigration which
necessarily involve questions of federalism, separation of powers, and
the ability and advisability, if any, of the Judiciary to hear and
